Dangerous Medical Products - How Can They Injure You?

Gambar
You have probably seen the commercials: "If you have been injured by a pelvic implant, call our law firm and join our class-action lawsuit today!" But what does that actually mean? Can anyone who received a potentially dangerous pelvic implant join a lawsuit, even if the device has not injured him or her? And even if you are injured by a medical device, does that guarantee your right to monetary compensation? Although permanent or semi-permanent med ical implant devices are the only treatment option for certain injuries, introducing non-organic products into the complex human body can cause serious medical issues that are often not anticipated by the makers of those products. Common Types of Dangerous Medical Products Some of the most dangerous medical products are non-organic medical implant devices, such as artificial joints, heart defibrillators (pacemakers), and surgical meshes . It is reported that tens of millions of Americans live with medical device implants , but d

Concussions and Children

Concussions and their associated injuries have become a hot-button topic over the last few years, especially in the sporting community, leading to several class-action lawsuits against various sporting organizations and even a blockbuster film starring Will Smith aptly titled Concussion. This seemingly newfound national interest in head injuries comes after a wave of studies that showed that bumps to the head can be much more serious than we previously realized. Up until very recently, most head injuries of the milder variety were thought to be treatable with a nap and painkillers, but, unfortunately, this is not adequate in most cases. While the effects of concussions and other head injuries can be serious for anyone, they are especially serious for children.  What Is a Concussion? Societal Effects of a Traumatic Brain Injury It is estimated that most survivors of severe traumatic b

What Happens When You have Workers Compensation and Personal Injury Claim?

Gambar
William Poremba was driving as part of his job for Southern Nevada Paving. While driving, he got into a car accident. See Poremba v. S. Nev. Paving, 133 Nev. Adv. Op. 2 (Jan. 26, 2017). William later filed a workers’ compensation claim through his employer. Since the accident wasn’t his fault, William also made a personal injury claim against the driver that hit him. William ultimately settled his personal injury claim. As is typical in most settlements, the settlement agreement didn’t specify how the funds were to be allocated. For example, there was no mention how much of the settlement would go towards for pain and suffering, medical bills or lost wages.   After he was done treating and his personal injury case settled, William tried to go back to work.  However, when William tried to go back to work, he realized that he needed additional medical care through the worker’s compensation program. However, William’s request to reopen his worker’s compensation claim was denied. William
