How Does Bankruptcy Affect a Personal Injury Settlement in Las Vegas?

Gambar
Today’s blog talks about how bankruptcy can affect personal injury settlements. Recently, the Nevada Supreme Court had to decide whether a person could have more than one active personal injury claim while still in bankruptcy. See Kaplan v. Dutra, 132 Nev. Adv. Op. No. 80 (2016). The high court determined that the injury party, who was also in bankruptcy, was entitled to get benefits from more than one personal injury claim.  In the Kaplan case, David Kaplan had two active personal injury claims. Kaplan was involved in a dog bite attack, where he injured his back. After the dog attack, Kaplan had back surgery. With a seemingly stream of bad luck, just six weeks later, Kaplan was rear-ended in a car accident. The car accident caused the need for Kaplan to undergo a second back surgery. Kaplan filed personal injury claims for both injuries. Kaplan later filed for bankruptcy. His two personal injury cases settled and he was set to receive his share of the settlement funds from both case

Florida Supreme Court Does Not Allow Insurer to Pursue Claims against Doctor

by  D arryl Ervin Rouson, Esq. It is important at Dolman Law Group to know the laws affecting full recovery. Injuries sustained in a car accident do not necessarily stop at the site of the crash. Further injuries may also incur on the way to the hospital or even once a person is under medical care. If an individual’s negligence caused a car accident, they may be responsible not only for injuries to another person from the crash, but also any injuries that person suffered while being treated for the initial injuries, including medical malpractice . The theory behind this is that the injured party would not be in the hospital to begin with if it wasn’t for the negligence of the person who caused the crash.  The Supreme Court of Florida ruled this month that an at-fault driver, or their insurance company, cannot sue the injured party’s medical provider before the at-fault driver has fully paid a judgment against them. In this case,  Holmes Regional Medical Center, Inc. v. Allstate Insur

Florida Boating Accidents and Alcohol

Gambar
When most people think of Florida, they imagine a tropical paradise. Soft, white sand in between your toes, the hot summer sun sinking behind crisp, blue waves, and an ice cold margarita melting in your hand. As residents, we know this scene to be a part of our reality. Florida’s natural beauty, including its extensive coastline, is just one reason why our state is now the 3rd most populous in the US. And that doesn't even take into account the “snowbirds." It's no wonder then that one of the best ways to appreciate that beauty of Florida is out on the water. Whether it’s by cruising around in a large catamaran or jumping wakes with a jetski, boating is about as Floridian as a glass of fresh-squeezed OJ. But just like the daily 3 PM thunderstorm, there can be some dark clouds on the horizon for boaters. Over half of all boating accidents are related to the use of drugs or alcohol. Although many of us know the criminal repercussions such a combination may bring, fewer Flor

Who is Liable When Your Child is Hit by a Car?

Gambar
Parenting is difficult - especially when you have active little ones. Young children do not have the same fears or instincts as adults, and children may walk or run out onto a busy street without comprehending the danger. Typically, if a pedestrian suddenly enters the road in front of another car and the driver does not have sufficient time to react, the driver is not liable for the pedestrian’s injuries either because the pedestrian assumed the risk of his or her behavior or because the pedestrian was the sole negligent party. But what happens if the pedestrian is a young child, or even an incompetent individual for that matter, who cannot comprehend the danger? Who is liable for the child’s injuries or the injuries the driver sustained in attempting to avoid the child? Parenting Laws and Responsibilities in Florida Under Florida law , a “caregiver” is defined as “a parent, adult household member, or other person responsible for a child’s welfare.” Ensuring that a child is well-cared
